  9. If your incorporated business has 50 or more employees and
  10. is considered to be in an industry that uses, generates, or
  11. stores hazardous materials in California, it must file an
  12. environmental fee return and pay an annual environmental
  13. fee based on its number of employees, as follows:

  25. While you might not think your business has anything to do
  26. with hazardous materials, the state aggressively interprets
  27. this law to apply to ALL corporations with 50 or more em-
  28. ployees.  Because of the state's extreme interpretation of
  29. the law, you may want to pay the fee and file for a refund
  30. at some point in the future, if you think your corporation
  31. does not "use, generate, or store" hazardous materials.  It
  32. seems likely that the state's position will be challenged
  33. in the courts, which might permit you a refund if you have
  34. filed for it before the statute of limitations has expired.
